Terms of Service

1. Acceptance of Terms

These Terms constitute a legally binding agreement between you ("User", "Parent", or "Account Holder") and Sweet Phoenix Creations Pty Ltd("Kryzzo", "we", "us", or "our") governing your access to and use of the Kryzzo platform, including all associated applications, websites, and services (collectively, the "Service").

By clicking "I agree", creating an account, or otherwise accessing the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy, which is incorporated herein by reference.

2. Description of Service

Kryzzo is an educational technology platform designed for children aged 5–12. The Service enables children to play engaging learning games (covering mathematics, logic, language, creativity, and more) and earn "KryzzoPoints" for their progress. These points may be redeemed by the child for supervised YouTube screen time within the Kryzzo app.

Parents and guardians access a dedicated dashboard to monitor their children's learning progress, set screen-time rules, manage point balances, and control platform settings. The Service is provided on a subscription basis with a free tier available.

3. Eligibility

• →Account Holders must be at least 18 years of age. Kryzzo accounts may only be created by parents, legal guardians, or other adults with parental authority over the children for whom the account is created.
• →By creating an account, you represent and warrant that you are at least 18 years old and have the legal authority to agree to these Terms on behalf of yourself and to provide parental consent for your child's use of the Service.
• →If we discover that an account has been created by or for someone under 18 as the account holder (not as a child profile under parental supervision), we reserve the right to terminate that account immediately.

4. User Accounts

When you create an account, you agree to:

• ✓Provide accurate, current, and complete information during registration.
• ✓Maintain and promptly update your account information.
• ✓Keep your password secure and confidential.
• ✓Be solely responsible for all activity that occurs under your account.
• ✓Notify us immediately at info@sweetphoenix.co.za if you suspect any unauthorised access to your account.

You may not share your account credentials with any other adult. Each account is for the use of a single family household.

6. Acceptable Use

You agree not to:

• ✗Use the Service for any unlawful purpose or in violation of any applicable law or regulation.
• ✗Attempt to gain unauthorised access to any portion of the Service or its related systems.
• ✗Share your account credentials with persons outside your immediate family household.
• ✗Reverse engineer, decompile, disassemble, or otherwise attempt to derive source code from the Service.
• ✗Introduce malware, viruses, or any malicious code into the platform.
• ✗Scrape, mine, or harvest data from the Service using automated means.
• ✗Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• ✗Use the Service to send spam, unsolicited communications, or promotional materials.

7. Intellectual Property

All content, software, design, graphics, text, sound, video, and other materials on the Kryzzo platform — including but not limited to all learning games, the KryzzoPoints system, branding, logos, and the "Kryzzo" name — are the exclusive intellectual property of Sweet Phoenix Creations Pty Ltd and are protected by South African and international copyright, trademark, and other intellectual property laws.

You are granted a limited, non-exclusive, non-transferable, revocable licence to use the Service for its intended purpose as a personal, family-use educational tool. No other rights are granted. You may not reproduce, distribute, create derivative works from, or commercialise any part of the Service without our express prior written consent.

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement, to the maximum extent permitted by applicable law.

We do not warrant that the Service will be uninterrupted, error-free, or completely secure, or that any defects will be corrected. We make no guarantees regarding specific educational outcomes.

10. Limitation of Liability

To the maximum extent permitted by the laws of the Republic of South Africa, Sweet Phoenix Creations Pty Ltd shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service.

Our total aggregate liability to you for any claim arising out of or relating to these Terms or the Service shall not exceed the total fees paid by you to Kryzzo in the three (3) months immediately preceding the event giving rise to the claim.

11. Termination

Either party may terminate the agreement at any time:

• →By you: Cancel your subscription at any time from your account settings. Access continues until the end of the current billing period.
• →By us: We may suspend or terminate your account immediately, without prior notice, for material breach of these Terms, fraudulent activity, non-payment, or conduct harmful to other users or the platform.
• →Upon termination, your licence to use the Service ceases immediately. We may delete your account data in accordance with our Privacy Policy.

12. Governing Law & Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the Republic of South Africa, without regard to its conflict of law provisions. Any dispute arising from or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Western Cape, South Africa.

13. Changes to These Terms

We reserve the right to modify these Terms at any time. When we make material changes, we will provide at least 14 days' notice by email and by posting a prominent notice on the platform. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes. If you do not agree to the updated Terms, you must cease using the Service and cancel your account.
